Cop going 95 mph on Sullivant Ave kills man, no charges filed
Franklin County Sheriff’s Deputy Brian Fritz was in pursuit of an alleged drunk driver on Sullivant Ave. and reached a maximum speed of 106 mph before he hit the brakes.
Deputy Fritz decelerated to 95 mph before slamming into the vehicle of 77-year-old Nyal Brown, who was pulling onto Sullivant from a private driveway. Brown was ejected from his vehicle and pronounced dead at the scene.
The police SUV of Deputy Fritz burst into flames, though Fritz managed to escape with minor injuries.
The speed limit on Sullivant Ave. is 35 mph.
Yesterday it was announced that Fritz will not be charged for killing Brown. Franklin County Prosecutor Ron O’Brien said that because Fritz was in pursuit of a suspect and he was on duty in his police cruiser, no laws were broken, so there is nothing to charge him with.
Brown’s brother disagrees, saying that he believes Fritz is guilty of reckless vehicular homicide.
“106 miles an hour–that is not justifiable to me,” Bill brown told WBNS news. “That’s like shooting a bullet at you.”
Fritz could still face disciplinary action for the accident, but it looks like jail time will not be a part of it.
