Oh craps! Ohio man challenges casino constitutionality

The Ohio Supreme Court said today that a Columbiana County man can challenge the the constitutionality of the 2009 law that legalized casino gambling in Ohio on the basis of his federal constitutional rights.

Frederick Kinsey said the 2009 law violates his federal constitutional rights under the basis of the Equal Protection Clause, because the 2009 law only allows a few companies to conduct casino gambling.

That is to say, because Kinsey can’t operate a casino in Ohio, he claims his federal constitutional rights are being violated.

The Court ruled Kinsey’s argument has enough merit that he may proceed with his arguments.
