Balcony gives way, father and daughter sue

A father and a daughter are suing a condo association after an upper level patio gave way, resulting in serious injuries.
The father, Roger Guess, suffered two shattered legs in the fall on May 30. His daughter fractured her vertebrae and pelvis and broke one of her hips in the fall. The two are still recovering.
The lawsuit is filed against Lifestyle Communities and Falls at Hayden Run Condominium Association. They are being accused of neglecting to repair at least one other suspended balcony in the complex and failing to inform residents of its potential danger.
Allegedly, only 16 small nails were securing the structure said to hold roughly 2,400 pounds. In the case of the Guesses, the balcony did not hold up.
