Kellogg suing popular Ohio food truck, seeking to get ‘all profits’

Remember the frozen waffle, Eggo commercials, with the tagline “L’Eggo my Eggo?” Well, a popular Ohio food truck is accused of playing off of the famous saying, naming their eggroll-centric food truck, “L’Eggo my Eggroll.”

And now, they’re being sued by the multinational food conglomerate Kellogg, worth $15 billion, who owns the Eggo brand.

According to Bloomberg Law and the Federal Court for the Northern District of Ohio, the Findlay, OH based food truck is in a lawsuit for trademark infringement. In the complaint, Kellogg says even the yellow paint scheme with the red cursive lettering mimics Eggo waffle packaging. 

According to the complaint, Kellogg sent letters to the food truck operators, demanding the food truck stop using the L’Eggo saying in their name. They even offered to pay the food truck $5,000 to change the name. 

The food truck allegedly did not make the requested changes. Kellogg alleges that L’Eggo my Eggroll “ignored Kellogg’s requests and responded with its own threats and demands.”

As a result, Kellogg not only demanded the food truck to stop using the name, but it is now seeking to “recover all gains, [and] profits” that the food truck has made from using the name. They’re also requesting that the food truck destroy all materials with the term “L’Eggo my Eggroll” on it.
