OSU files lawsuit against Michigan restaurant over drink name that mocks the Buckeyes

The OSU vs. Michigan rivalry continues, but this time, it’s off the football field and in a court room.

On Wednesday, OSU filed an opposition to stop an Ann Arbor bar, right next to the University of Michigan’s campus, from trademarking a drink that mocks The Buckeyes. The Brown Jug, which sells a beer called “Buckeye Tears” on draft, applied to trademark the name for beer and liquor.

OSU claims that The Brown Jug is infringing on Buckeye copyright by offering this drink named Buckeye Tears. The legal team says that the name could mislead customers into thinking OSU is connected to the alcoholic beverage.

The Brown Jug has until October 6 to respond. But on August 28, the restaurant made light of the situation and posted a video with the caption, “Looks like OSU wants to trademark ‘Buckeye Tears’… funny, we’ve been serving them for years. Stop by The Jug and grab one off the menu — no paperwork required.”
