Central Ohio father sues local hospital after newborn baby falls from crib

An accidental yet tragic incident occurred at a local hospital, and a grieving father is seeking justice.

In a lawsuit filed this week, Zanesville father Tyler Peyton alleges that his daughter, Ellieana, died at the hands of Nationwide Children’s Hospital only 27 days after her birth due to “medical negligence, wrongful death, and misconduct.”

Ellieana was born on March 4th but was admitted to Nationwide Children’s Cardiothoracic Intensive Care Unit after she was diagnosed with a heart condition.

She had wires attached to her for heart monitoring, and the cords were attached to a box that the care assistant had in her pocket. Allegedly, the care assistant left the rail down on Ellieana’s crib, and when the assistant walked away from the crib, the wires allegedly pulled Elliana over the crib.

According to the lawsuit, Ellieana fell approximately three to four feet to the floors.

That evening, Elliana received a brain scan that showed she had brain bleeding and a skull fracture. Her health began to deteriorate, with the records showing this included hypotension, decreased oxygen saturation, and a rapid heartbeat.

Three days after the incident, Elliana had to undergo CPR and be intubated due to an acute cardiopulmonary collapse. The lawsuit says that further testing showed she had severe brain injuries caused by a lack of oxygen reaching her brain.

Ellieana died on March 31. Her autopsy, performed by the Franklin County Coroner’s Office, says she died from an accident—her congenital heart defect complicated by the head injury from the fall.
