The Ohio Supreme Court is currently deciding on whether or not a backpack search that led to the discovery of bullets and a gun is constitutional.
It took two lower courts tossing out the evidence due to a second search before Prosecutors appealed to the Supreme Court.
The main argument is whether the second search of the bag violated privacy rights of the student. The high court has schedule their arguments for Wednesday.
A security guard at a Columbus city high school searched a student’s backpack in 2013 after it was found on a bus. The individual then conducted a second search after he remembered the student’s gang ties. It was that second search that led to finding a gun on the student.
