Juveniles No Longer Automatically Tried as Adults

The Ohio Supreme Court overruled a previous law that stated juvenile convicted of murder or other serious crimes be automatically convicted as adults.

Parts of the law was deemed an unconstitutional violation of a juvenile’s right to due process, such as the mandatory transfer from juvenile court to common pleas court.

The court voted 4-3 to get rid of life sentences for juveniles convicted of serious crimes other than murder, and life sentences without appropriate parole requirements.

These decisions come after cases of a juvenile convicted with a life sentence with parole periods late into their sentence, and a juvenile transferred to adult court for aggravated robbery with a firearm.
